Terms and Conditions - University of Auckland Online Ordering Platform

1. Introduction
These Terms and Conditions (“Terms”) govern the use of the University of Auckland online ordering platform (“Platform”) operated by Collective Hospitality Ltd (“we”, “us”, “our”).
The Platform is provided to support catering and hospitality services delivered to the University of Auckland (“the University”). By accessing or placing an order through the Platform, you agree to be bound by these Terms.
2. Authorised Use
The Platform is intended for use by:
• University of Auckland staff
• University of Auckland students
• University-approved contractors, departments, and authorised purchasers
By placing an order, you confirm that you are authorised to make purchases in accordance with University of Auckland procurement and financial policies.
3. Orders
• All orders placed through the Platform are subject to acceptance and availability.
• We reserve the right to decline, amend, or cancel an order where required for operational, availability, compliance, or pricing reasons.
• Once an order is confirmed, changes may not be possible.
4. Pricing and Payment
• All prices are displayed in New Zealand Dollars (NZD) and include GST, unless otherwise stated.
• Payment is required at the time of ordering unless alternative billing arrangements have been approved by the University.
• Credit and debit card payments are processed securely via an approved third-party payment provider. We do not store full credit card details.
5. Refunds and Cancellations
5.1 Cancellations
• Orders may be cancelled prior to preparation or fulfilment, subject to operational cut-off times and University event requirements.
• Cancellation cut-off times may vary depending on the nature of the order and will apply as communicated at the time of ordering.
5.2 Refunds
Refunds may be issued where:
• An order is cancelled in accordance with these Terms
• Goods or services are not provided as ordered
• There is an error or fault attributable to us
Refunds will be processed to the original payment method used, unless otherwise agreed. Processing times may vary depending on the payment provider.
5.3 Non-Refundable Orders
Once preparation or fulfilment has commenced, orders may be non-refundable except where required under New Zealand consumer law.
6. Consumer Guarantees
Nothing in these Terms limits any rights or remedies available under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986, where applicable.
7. Platform Use
Users must not:
• Use the Platform for unauthorised, unlawful, or fraudulent purposes
• Attempt to interfere with the security, availability, or functionality of the Platform
• Submit false, misleading, or incomplete information
We may suspend or restrict access where misuse is identified.
8. Liability
To the maximum extent permitted by law:
• We are not liable for indirect, incidental, or consequential losses arising from use of the Platform.
• Our total liability in connection with any order is limited to the value of that order.
9. Intellectual Property
All content on the Platform, including branding, text, images, and logos, remains the property of Collective Hospitality Ltd or its licensors and may not be reproduced without permission.
10. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be published on the Platform and will apply to future orders.
11. Governing Law
These Terms are governed by the laws of New Zealand, and the courts of New Zealand have exclusive jurisdiction.
